Terms and conditions
General terms of GrünReich Bau & Dienstleistungen for construction, outdoor and service contracts.
As of October 2026. This is an English translation; the German version is legally binding.
1. Scope
These terms apply to all contracts between GrünReich Bau & Dienstleistungen, owner Meriton Berisha, Reiherweg 12, 89231 Neu-Ulm, Germany (“contractor”) and its customers (“client”) for landscaping, outdoor areas, paving, earthworks, machine work and property services. Deviating terms of the client only apply if expressly agreed in writing.
2. Quotes and conclusion of contract
Website content is not a binding offer. Quotes are non-binding and valid for 30 days unless stated otherwise. The contract is concluded by written order or order confirmation, including by email.
3. Scope of work and changes
The scope of work is defined in the quote. Additional or changed work requested by the client or found to be necessary during execution (for example due to unforeseeable ground conditions or hidden utilities) is charged separately by agreement. The client is informed before such work is carried out.
4. Prices and payment
Prices for consumers include statutory VAT; prices for businesses are plus statutory VAT. Unless agreed otherwise, invoices are payable within 14 days without deduction. The contractor may request instalments for work performed and materials delivered (§ 632a BGB).
5. Execution, dates and weather
Dates are agreed jointly. Delays caused by weather, force majeure, supply shortages or circumstances attributable to the client extend the execution period appropriately.
6. Client’s obligations
- Free and safe access to the site and sufficient storage and work areas
- Information on the location of utilities on the property
- Obtaining any required permits unless agreed otherwise
- Providing electricity and water where required
- Clarifying neighbour law issues, for example for boundary structures or fences
7. Acceptance
After completion the work is jointly accepted (§ 640 BGB). Minor defects do not entitle the client to refuse acceptance. Plants are living materials whose growth depends on care and weather.
8. Warranty
Statutory warranty rights apply. Defects must be reported promptly. The contractor is first entitled to remedy. Natural variations in colour and structure of stone, efflorescence, normal wear and damage from improper use or lack of care are not defects.
9. Liability
The contractor is fully liable for intent and gross negligence and for injury to life, body or health. For slightly negligent breach of essential contractual obligations, liability is limited to typical, foreseeable damage. Otherwise liability for slight negligence is excluded.
10. Retention of title
Delivered materials remain the contractor’s property until paid in full, unless they have become an integral part of the property.
11. Recurring services
For recurring services such as caretaking, garden care, winter service or cleaning, the intervals, terms and notice periods agreed in the quote apply. Winter service covers clearing and gritting within the agreed scope and times; complete freedom from ice at all times cannot be guaranteed.
12. Right of withdrawal for consumers
Consumers have a statutory right of withdrawal for contracts concluded off-premises or exclusively by distance communication. The withdrawal information and model form are provided with the quote or order confirmation.
13. Data protection
Please see our privacy policy.
14. Final provisions
German law applies. For merchants and legal entities under public law the place of jurisdiction is Neu-Ulm. Should individual provisions be invalid, the remaining provisions remain unaffected.
